Terms of use for Brunel University London’s
VerifyAward validation website

 

These terms of use apply to the VerifyAward validation website (“validation website”).  If you do not accept these terms of use, please do not use this validation website.  Brunel University London (the “University”) may update these terms from time to time and any changes will be effective immediately on being set out here. Please ensure you are aware of the current terms.

Use

Please note that the University’s validation website is made available to University graduates (“Graduates”; “you”) and to third parties nominated by Graduates including but not limited to employers, recruitment agencies, educational institutions and other third parties (each a “Third Party”).  The validation website provides Graduates with the ability to view their qualification details and documents securely online.  The validation website also provides the ability for Graduates to instigate a connection with their nominated Third Party.  Subject to accepting the connection request from the Graduate, the Third Party can then view the Graduate’s qualification details and documents as authorised by the Graduate so that the Third Party can easily verify the authenticity of a Graduate’s University award. 

Use of the validation website is free for Graduates but a charge applies for a Third Party’s use of the validation website.

The use of the validation website is subject to these terms.

Users must not use the validation website to:

  • commit or encourage unlawful acts or in breach of these terms of use;
  • misrepresent your identity;
  • hack, or attempt to hack, any part of the website or any system used to run it;
  • store personal data derived from the website;
  • technically harm the validation website (including, without limitation, through introducing computer viruses or malicious software or harmful data).

While the University tries to make this validation website available 24 hours a day, it reserves the right to suspend or withdraw access, without notice, to either the whole or part of the validation website, for any reason.

Services

Use by Graduates:  As a benefit to Graduate, the validation website will allow you to do the following:

  • View your certificate
  • View your study and award details
  • View your transcript of studies or Higher Education Achievement Report (“HEAR”) (if available)
  • Instigate a connection or approve a connection request with a Third Party to share any of the above documents you authorise through the validation website

To register on the validation website, the Graduate will be required to provide an email address.  It is important to remember this email address because this is the email address you will need to use each time you return to the validation website and you will need to supply this email address to any Third Party when you instigate a connection.

The information displayed on the validation website originates from your student records collected and processed in accordance with your student contract with the University.  Only you can consent to connecting with a Third Party and authorising the sharing of your qualification details and documents with the Third Party through the validation website.  As you are solely responsible for specifying the Third Parties you wish to connect with you should ensure that you are giving permission to only those Third Parties you wish to connect with.  You can set the duration for which the Third Parties will have access to the validation website to view your qualification details and documents, and you can extend this time period as needed.  The University cannot make any connections with any Third Parties on your behalf, nor amend the qualification details or documents to be shared nor the duration.  By instigating a connection with a Third Party you are expressly confirming your approval for the University to process your personal information in this way.

Note this service is available to Graduates who graduated with the University after October 2008.

Use by a Third Party: As a benefit to Third Party, subject to paying the applicable charge, the validation website will allow a Third Party to do the following:

  • View/Confirm the Graduate’s attendance at the University
  • View those qualification details and documents (specified above under the section on “Use by Graduates”) the Graduate has authorised the Third Party to view through the validation website
  • Validate the Graduate’s qualifications

Upon receiving a connection request from a Graduate, a Third Party can use the validation website to verify a University Graduate’s qualification details and documents, subject to paying the then-applicable fee to access the validation website.  If a Third Party is not willing to pay a fee for this service then they should not activate the connection request.

A Third Party is making this connection because a Graduate has instigated and authorised the connection by sending the Third Party a connection request.  Only Graduates have the authority to specify the duration of the connection.  If the connection expires and the Third Party requires further access, then the Third Party must contact the Graduate directly.  The University cannot make any connections with any Graduate on behalf of a Third Party, nor specify the qualification details or documents to be shared with a Third Party, nor the duration of the connection. 

How to pay

This service is free to Graduates.  The Third Party will have to pay the applicable fee specified on the validation website, from time to time, to complete a connection with a Graduate.  Payment is required before any connection can be completed.  All payment collections will be handled by Capita Software (“CS”), part of Capita plc Group.  As part of the connection process the Third Party will be diverted to CS’s payment collections platform to process the payment.  The Third Party can review how CS will handle any data a Third Party provides to CS during the payment process by checking CS’s privacy policy located here: https://www.pay360.com/privacy.

For the avoidance of doubt, once the Third Party has paid the applicable charge, the Third Party will be able to complete the connection to the Graduate and view the Graduate’s qualification details and documents securely online through the validation website.  Save for verifiable technical issues, the Third Party has no cancellation or refund rights once the connection has been completed and the Third Party has been given the ability to view the Graduate’s qualification details and documents.  The third Party should view the Graduate’s qualification details and documents in accordance with the duration settings specified by the Graduate.  Note, only the Graduate can specify the duration settings.  If the duration expires and the Third Party needs more time to view the Graduate’s qualification details and documents then the Third Party needs to contact the Graduate directly who can authorise a longer duration for the connection.  There is no additional charge to the Third Party for this extension.  Any failure of the Third Party to complete the connection and/or view the Graduate’s qualification details and documents is entirely at the Third Party’s own risk.

The University reserves the right to suspend or withdraw access, without notice, to either the whole or part of the validation website, for any reason.

Liability

To the fullest extent permitted by law, the University excludes all liability and responsibility for any amount or kind of loss or damage that may result to a Graduate or a Third Party in connection with the use of this validation website in any way.  Nothing will limit the University’s liability for death or personal injury caused by its negligence or for fraud.

Every effort is made to ensure downloadable content is free from viruses. The University accepts no liability for damages resulting from virus infection.

Copyright, trademarks and other intellectual property

Users may use the website for the limited purposes specified above.

Unless stated otherwise, the copyright and other intellectual property rights in all text, images and other material on this validation website are owned by the University, or its licensors.

The trade marks and logos used and displayed on the validation website are the University’s registered and unregistered trademarks, or those of others. You may not use these trademarks without the University’s written consent, or that of the relevant owner.

Data protection

Access to the validation website from outside the EEA: Connections can only happen with a Graduate’s consent.  Whilst the Third Party can view the Graduate’s qualification details and documents through the validation website securely online, the Third Party may download a Graduate’s qualification details and documents and store them locally.  Therefore, Graduates must be aware that depending on the location of the Third Party their qualification details and documents (which includes personal data) will be viewed from and transferred to countries outside of the European Economic Area ("EEA"), which may not have the same data protection laws as those of the UK.

Governing law and jurisdiction

These terms of use are governed by English law. Disputes arising in connection with them shall be subject to the non-exclusive jurisdiction of the English courts.

Miscellaneous

These terms of use are not intended to, nor shall they confer any benefit on a third party, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

No waiver by the University of any breach of these terms by you shall be considered as a waiver of any subsequent breach of the same or of any other provision.

Section headings have been included for convenience only and shall not be considered part of, or be used in interpreting, these terms.

If, at any time, any provision of these terms is or becomes invalid or illegal in any respect, such provision shall be deemed to be severed from the terms, but the validity and enforceability of the remaining provisions shall not be affected as a result.
